Review: Sports Law By Mark James

‘Sports Law’, written by Professor Mark James and published by Palgrave Macmillan is the most up to date and serious proposition in the current Sports Law academic books panorama.

Mark James, one of the authors of the book ‘Sports Law’ published by Cavendish Publishing (last edition of 2006), goes solo on this mission. The result is a more comprehensive and useful book, not only for students of the topic, but also for practitioners wanting to learn from scratch.

Where the previous ‘Sports Law’ dedicated endless number of pages to debate whether there is such a thing as ‘Sports Law’ or the number of resolution of the Council of Europe, or the reports about football of the nineties, Mark James goes straight to the point (see chapter 1).

The idea of the text is brilliant: a compilation of all the must know information about sponsorship for managers of companies which need to face a great deal of decisions about the topic. But not only that, the report is also good for practitioners who want to read experts' opinions as well as academics and students involved with sponsorship; a great deal of people interested in this industry would be attracted to this publication.

The report draws opinions from different operators: best known solicitors (Bird and Bird, K&L Gates, Farrer & Co, Onside Law amongst others); barristers (Jonathan Crystal, of Cloister Chambers) and clubs (Zoë Ward, of Liverpool FC).

Part of a compilation about Sports Law launched by the Spanish publisher, Dykinson, S.L., the book of Juan de Dios Crespo and Ricardo Frega comes to fill an incomprehensible gap in the current legal literature panorama.

With the only exception, probably, of ‘The Jurisprudence of the FIFA Dispute Resolution Chamber’ (Asser International Sports Law Series), which is in fact quite different in focus and study, there are no books studying the Regulations on the Status and Transfer of Players.

Sports Law encompasses both autonomous as well as state created rules regarding the variety of economic, social, commercial, cultural and political aspects of sports activities.

This regulation may take the form of autonomous self-regulation, e.g. by national and international associations of sport. These private regulations or by-laws, including organisational, disciplinary rules as well as rules of play, constitute the so-called ‘lex sportiva’.

However, the trend towards more professionalism in sport and the growing economic, social and cultural relevance of sport have prompted an increasing reliance on legal rules adopted by the public authorities. These regulations include for example criminal law, labour law, commercial law, tax law and so on, which may vary following a particular type or sector of sport.

Ian Hewitt, a member of the management committee of the Wimbledon Championships who as a solicitor helped in the formation of the Premier League, looks at cases as diverse as US baseball’s ‘Shoeless’ Joe Jackson and the selling of the 1919 World Series to Eric Cantona’s kung-fu attack on a fan in 1995.

Football also supplies Duncan Ferguson and Bobby Moore while among the many other top sports stars appearing are Lester Piggott and Kieren Fallon from horse racing; Ben Johnson and Christine Ohoruogu from athletics; Ian Botham and Hansie Cronje from cricket; Eddie Irvine from motor racing; Tiger Woods from golf; Michael Watson from boxing; Stephen Hendry from snooker; Phil Taylor from darts and Greg Rusedski from tennis.

All have contributed, some reluctantly, to the history of leading sporting encounters with the law.

The 32nd America's Cup Jury and its Decisions

More than the most prestigious regatta and match race in the sport of sailing, the America’s Cup is a test of boat design, sail design, fundraising, and management skills. It is not surprising that its passionate skippers, builders and managers should often become embroiled in disputes. Recognizing this, and to minimize jurisdictional issues, the Cup’s organization has included its own international jury for over thirty years.

The 31st jury, however, for the first time in the Cup’s long and colourful history, appointed a five-member arbitration tribunal which has now become an established part of the Cup’s ‘corporate’ identity. Although the tribunal’s decisions are not intended to be binding in the future, experience has already proven that they may assist whoever is involved in forthcoming competitions. In validation of this recognition, this book compiles all the decisions issued by the tribunal about cases submitted to the 32nd jury. This entails forty-three decisions in all, encompassing decisions on the merits for thirty-six cases, as well as a series of interim, provisional or partial decisions and, in one case, a dissenting opinion.

Among the subjects of dispute are the following:

* alleged errors in calling a very close finish; * alleged errors in rules resolving a tie; * redress regarding physical damage; * failure of boat electronic system; * allegations of outside help; * scope of advertising on a yacht; * place of yacht construction; * receipt of meteorological data while racing; and * on-board installation of TV equipment.

In addition to the full texts of the decisions, the book includes the America’s Cup Deed of Gift (the ‘constitutional’ document), the Protocol governing the 32nd America’s Cup, Rules of Procedure, Terms of Challenge, and applicable anti-doping and anti-gambling rules. A valuable introduction offers, as well as historical and legal background, some personal perspectives by Jury members.

Perhaps the most interesting aspect of this subject for practitioners in general is the symbiosis quickly established between the America’s Cup organization and the World Intellectual Property Organization (WIPO). At the request of the Cup’s management, WIPO developed a customized web-based facility for the rapid and secure resolution of disputes – a facility now available in the context of other sporting events and for intellectual property disputes in general. With detailed information on this system, along with the book’s many insights into the kinds of issues that fuel disputes in sports events (and their resolutions), Arbitration in the America’s Cup offers a significant extension of the knowledge base available to lawyers and scholars in several branches of law and legal practice.

The Future of Sports Law in the European Union: Beyond the EU Reform Treaty and the White Paper

This new collection of essays presents nine well-informed and insightful analyses of the ‘specificity’ debate from several distinct points of view. The book reprints the papers presented by outstanding academics as well as representatives of the sport world at a conference on the ‘Future of Sport in the European Union’ held at the Catholic University of Brussels in December 2007. The authors examine the legal and political issues related to the latest developments at the EU level, and their impact on the sport organisations, in order to better understand the future of sport and to answer the questions which will inevitably arise from the new situation.
