0993/17 Hairston v/ AEK Athens BC

The American Player Malik Hairston filed a claim against the Greek Club AEK Athens BC for outstanding salaries, reimbursement of a visa fine, agent fees, penalties and interest. The Claimant submitted that the Respondent terminated the Contract without just cause resulting in damages to the Claimant as he contended that the Respondent’s alleged reason of the failure of the medical examination before the second season was merely a pretext to terminate the Contract prematurely. In its Answer, the Respondent argued that it was entitled to terminate the Contract due to the Claimant’s failure of the initial medical examination before the second season. The claim was partially upheld.
