The Court of Arbitration for Sport (CAS) has issued a decision today in the appeal arbitration procedures initiated by the Brazilian football club Sport Club Internacional against Esporte Clube Vitória Da Bahia, the Confederação Brasileira de Futebol (CBF), the Superior Tribunal de Justiça Desportiva de Futebol (STJD) and the STJD General Prosecutor.
CAS has no jurisdiction to hear the appeals from Sport Club Internacional against Infringement Notices 425/2016 and 71/2016 that were issued by the STJD General Prosecutor on 19 December 2016.
Accordingly, the arbitration procedures before the CAS have now concluded and the results table of the 2016 Brazilian Série A championship is unchanged.
Sport Club Internacional filed two appeals at the CAS in January 2017 against the infringement notices issued by the STJD General Prosecutor in December 2016 in which the General Prosecutor declined to investigate alleged anomalies in the registration of Esporte Clube Vitória Da Bahia’s player Victor Ramos. In its appeal to the CAS, SC Internacional sought an order from the CAS Panel for points to be deducted from Esporte Clube Vitória Da Bahia’s 2016 Brazilian Série A championship points in order for Sport Club Internacional to finish in 16th position, above Esporte Clube Vitória Da Bahia.
The procedures were conducted on an accelerated basis in order for CAS to give its decision before the start of the 2017 Série A championship. A hearing was held at the CAS headquarters in Lausanne, Switzerland on 4 April 2017 during which the Panel of arbitrators appointed to decide the matter decided to issue a preliminary decision on jurisdiction.
